Important terms for using In the Moment

These Terms of Service are an agreement between you and Kaufman Inclusion Group, LLC. By creating an account, purchasing a plan, opening a shared profile, or otherwise using In the Moment: A Family Guide, you agree to these terms.

General information only

In the Moment offers general educational information and practical suggestions for families and caregivers. It does not provide medical, clinical, psychological, therapeutic, legal, or other professional advice. The app is not a substitute for advice, diagnosis, or treatment from a qualified professional who knows the child and family.

Suggestions may not be appropriate for every child or every situation. You are responsible for deciding whether and how to use any information in the app. Never restrain, pressure, or force a child to follow a suggestion.

Not an emergency service

The app does not monitor profiles, messages, or emergencies and cannot contact emergency responders. If anyone is in immediate danger or there is a medical or safety emergency, call 911 or the appropriate local emergency service. Do not wait for information from this app.

Parent-created content and responsibility

Parents and guardians create the child-specific profiles, instructions, Do and Don't tips, and other information shown to caregivers. Kaufman Inclusion Group, LLC does not create, verify, endorse, or continuously review that child-specific content.

The parent or guardian who enters information is responsible for making sure it is accurate, current, lawful, appropriate for the child, and suitable to share with each invited person. Parents should update or remove information when a child's needs change. Caregivers should contact the parent or guardian when instructions are unclear or appear out of date.

Do not enter information you do not have the right to provide. Avoid unnecessary medical, legal, or other highly sensitive details. If another parent or guardian shares responsibility for the child, you are responsible for obtaining any consent needed before entering or sharing the child's information.

Accounts and sharing

Accounts are for adults. You are responsible for your account, password, and activity under your account. Give access only to people you trust and turn off access when it is no longer needed.

Private care links can be opened by anyone who receives them. A recipient could forward a link or show profile information to someone else. Parents are responsible for choosing recipients and for using the app's access controls. Recipients must keep child information private, use it only to care for the child, and not copy, publish, sell, or misuse it.

Acceptable use

You may not use the app to harm, exploit, threaten, harass, discriminate against, or violate the rights or privacy of any person.

You may not attempt to access another family's information without permission, bypass security, disrupt the service, introduce malicious code, scrape the app, or use the app for an unlawful purpose. We may suspend or end access when we reasonably believe these terms, another person's rights, or the safety of the service have been violated.

Plans, renewals, and cancellation

Prices and plan details are shown before purchase. An annual plan renews automatically at the disclosed interval and price unless you cancel before renewal. You can turn off auto-renew from your account. Cancellation stops future renewals, and access ordinarily continues through the paid period. Founding Family access is a one-time purchase as described at checkout.

Payments are processed by Stripe under its own terms. Taxes, promotions, refunds, and any exceptions are shown at checkout or handled as required by law. Deleting an account does not by itself cancel an active subscription, so cancel the subscription before requesting account deletion.

Ownership

You keep ownership of content you enter. You give Kaufman Inclusion Group, LLC permission to host, process, display, and share that content only as needed to operate the app and follow your sharing choices.

The app's design, guide text, branding, and original materials belong to Kaufman Inclusion Group, LLC or its licensors and are protected by intellectual property laws. Personal use is permitted. Republishing, selling, or creating a competing resource from those materials is not permitted without written approval.

Service availability and changes

We work to keep the app useful and available, but do not promise uninterrupted, error-free, or permanently available service. Features may change, and maintenance or events outside our control may interrupt access. Keep a separate copy of information you may need during an emergency or without internet access.

Disclaimer and limitation of liability

To the fullest extent permitted by law, the app and its content are provided "as is" and "as available," without warranties of any kind. Kaufman Inclusion Group, LLC does not guarantee that a suggestion will work, prevent harm, or be suitable for a particular child, caregiver, or situation.

To the fullest extent permitted by law, Kaufman Inclusion Group, LLC and its owner, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss arising from reliance on general guidance, parent-created content, a shared link, unavailable service, or unauthorized access caused by a user's sharing or account practices.

Where liability cannot legally be excluded, the total liability arising from the app will not exceed the amount you paid to Kaufman Inclusion Group, LLC for the app during the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Kaufman Inclusion Group, LLC and its owner, employees, and contractors from claims, losses, and reasonable costs arising from content you enter, people you share it with, your misuse of the app, or your violation of these terms or another person's rights.

Ending use and deleting information

You may stop using the app at any time. Account and child-information deletion are described in the Privacy Policy. We may suspend or terminate access for serious or repeated violations, unlawful activity, security risk, or nonpayment. Sections that by their nature should continue after termination will remain in effect.

Governing law

These terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Any dispute not resolved informally will be brought in a state or federal court with jurisdiction in New Jersey, unless applicable law gives you the right to bring it elsewhere.

Changes to these terms

We may update these terms as the app or law changes. The current version and its update date will remain on this page. If a change materially affects your rights, we will provide reasonable notice in the app or by email when required.
